The Transformation with Chris Billing Policy

PLEASE READ THESE BILLING POLICIES CAREFULLY.

Usage of Transformation with Chris and Transform Coaching services constitutes customer’s acceptance of Transformation with Chris’ billing policy, and all customers must comply with this billing policy.

  • Unless otherwise agreed in writing, all accounts are set up on a prepaid basis, and payment must be received by Transformation with Chris before any billable product or service is provided/activated. Customers are required to keep a valid credit/debit card on file to charge for recurring monthly subscription fees.
  • Subscription billing is based on the availability of products and services, not based on usage.  Disabled applications will incur monthly subscription fees, regardless of the availability of the product in the case of a breach of online terms including but not limited to delinquent accounts.
  • Customers are responsible for keeping all credit/debit card details and contact information current. This can be done online through the Customer Center. To access the Customer Center, customers should visit TheTransformApp.com, click on “LOGIN” (upper right corner) and then click “Payment methods”.
  • All recurring subscriptions are automatically invoiced and charged to the credit/debit card on file.
  • Customers can access Order and Subscription details through the Customer Center.

Free Trials

All subscription options offer new users the first 7 days of free unrestricted access to Transformation with Chris.

Free trials are only available to new users and are provided at our sole discretion and not available in conjunction with other offers that we may have from time to time. Please be aware that if you attempt to sign up for an additional free trial, you will be immediately charged with the standard Subscription Fee.

We reserve the right to revoke your free trial at any time.

You may cancel anytime on the platform where you created your user account within the first 7 days, otherwise, you will be charged for the subscription after your 7-day free trial ends.

All free trials started through the Google Play Store are linked to the Google account registered on the device. Users are only eligible for 1 x free trial with their Google account, even where a separate or new email is used to sign up. Google Play requires cancellation requests to be made at least 24-hours prior to the end of your 7-day trial.

All free trials started on the Apple App Store are linked to your Apple account registered on the device. Users are only eligible for 1 x free trial with their Apple account, even where a separate or new email is used to sign up.

Subscription Purchase

All purchases on the Website are subject to the Terms and Conditions. Subscriptions can be purchased either directly from: 

  1. An In-App purchase or B. A Website purchase.
  • In-App Purchase

These include a purchase made via an external App Store, such as the Apple App Store or Google Play Store (“In-App Purchase”).

An In-App Purchase is purchased from and billed by the respective App Store, not by Transformation with Chris (Triaxiom, LLC) directly. (us).

You agree that: an In-App Purchase is also subject to the terms, conditions, and other licensing arrangements specified by that App Store provider;

(a) In-App Purchases are processed securely via the payment gateway used by the relevant App Store provider; and

(b) For purchases made via the Apple App Store you must raise with the App Store directly any payment-related issues you experience with an In-App Purchase or cancel requests.

(c) For purchases made via the Google Play Store you must raise with the Play Store directly any payment-related issues you experience with an In-App Purchase or cancel requests.

All payments made on the iOS app are charged via your Apple ID account and are controlled and managed by Apple.

All payments made on the Android app are charged via your Google Play account and are controlled and managed by Google.

  • Website Purchase

Subscriptions purchased directly from the Website are managed and billed by Transformation with Chris (Triaxom, LLC).

All Website Purchases are processed securely via our third-party payment gateway providers.

All transactions are handled over SSL (secure sockets layer) and are PCI (payment card industry) compliant. Transformation with Chris does not store your credit card details but will be securely stored by Braintree Payments (payment processing platform; https://www.braintreepayments.com/). 

Payment Methods

Transformation with Chris accepts payments via credit/debit card. Transformation with Chris currently accepts American Express, MasterCard, Discover, and VISA credit/debit cards.

Billing Cycle / Payments

App Subscriptions: Transformation with Chris offers monthly, quarterly, yearly, and lifetime subscription options. Subscriptions are payable upfront in lump sums at the commencement of the subscription. 

All credit/debit cards are automatically charged on the customer’s specific billing cycle date. Customer billing periods typically begin on the day of the month in which the customer purchased Transformation with Chris subscription. Customers must request to cancel their subscriptions at least 24 hours prior to their next billing date in order to avoid being charged on the billing date. In the event of cancellation, customers will still have access to their applications through the end of their final billing period. Transformation with Chris will not prorate any portion of unused subscription services. All subscription fees are nonrefundable.

For the purposes of our monthly, quarterly, and yearly subscriptions, a month constitutes 30 calendar days, a quarter constitutes 90 days, and a year 365 days. The lifetime subscription constitutes 30 years or until the date, the Company ceases to commercially offer the App.

The purchase of the App consists of an initial charge, followed by recurring period charges as agreed to by you. Special promotional pricing applies to the first billing cycle only. All recurring charges will be charged at the standard subscription price. By choosing a recurring payment plan, you acknowledge that such Services have a recurring payment feature and you accept responsibility for all recurring charges prior to cancellation.

If you have purchased your Subscription via our Website, you are required to let us know if your Payment Method changes. You can do this by visiting TheTransformApp.com. Click on “LOGIN” (upper right corner) and then click “Payment methods”.

We will assume your Payment Method is correct and will continue to bill Subscription Fees and charges relating to your Subscription by your nominated Payment Method:

  1. a) If any Subscription Fees billed to your account are not processed for any reason we may suspend your Subscription until payment is made in full.

We reserve the right to vary the Subscription Fees from time to time, but only for the next and subsequent billing periods. In that event we will give you reasonable notice of the variation before it will come into effect; and

  1. a) If your purchase was made via the Website and you do not cancel your subscription before your next billing cycle, you will be deemed to have accepted the variation.
  2. b) If your purchase was made via the Apple App Store or Google Play Store and if you do not accept the price increase, your Subscription will automatically be canceled.

Monthly (1 month) App Subscription. This subscription is paid in monthly installments. For each month that your subscription is active, you acknowledge and agree that the company is authorized to charge the same payment method that was used for the initial subscription purchase. You will be charged the standard monthly subscription fee ($14.99). If you initially purchased the App under a promotional price, please note that all subsequent charges after the initial promotional purchase will be billed at the standard price of $14.99 per month. The renewal subscription fees will continue to be billed to the Payment Method you provided, automatically each month until canceled. You must cancel your subscription within 24 hours before it renews each month in order to avoid billing the next subscription fee to the payment method you provided. Refunds cannot be claimed for any partial-month subscription period.

Quarterly (3 months) App Subscription. This subscription is paid in quarterly installments. For each quarter that your subscription is active, you acknowledge and agree that the company is authorized to charge the same payment method that was used for the initial subscription purchase. You will be charged the standard quarterly subscription fee ($38.99). If you initially purchased Transformation with Chris under a promotional price, please note that all subsequent charges after the initial promotional purchase will be billed at the standard price of $38.99. The renewal subscription fees will continue to be billed to the payment method you provided, automatically every 3 months (quarterly) until canceled. You must cancel your subscription within 24 hours before it renews each quarter in order to avoid billing the next subscription fee to the payment method you provided. Refunds cannot be claimed for any partial-quarter subscription period.

Yearly (12 months) App Subscription. This subscription is paid in yearly installments. For each year that your subscription is active, you acknowledge and agree that the company is authorized to charge the same payment method that was used for the initial subscription purchase. You will be charged the standard yearly subscription fee ($119.99), even if your initial charge was discounted. The renewal subscription fees will continue to be billed to the Payment Method you provided, automatically every year until canceled. You must cancel your subscription within 24 hours before it renews each quarter in order to avoid billing the next subscription fee to the payment method you provided. Refunds cannot be claimed for any partial-year subscription period.

Lifetime App Subscription. This subscription is paid for by a one-time upfront payment and is non-refundable. The lifetime subscription constitutes 30 years or until the date, the Company ceases to commercially offer the App.

Cancellation Process

Unless you cancel or opt-out of automatic renewal of your subscription before the expiry of your Subscription, your subscription will renew at the monthly rate of $14.99, unless otherwise stated.

After cancellation, you will continue to have access to Transformation with Chris for the remainder of your billing period.

To cancel your subscription you will need to go to the platform your subscription was created on.

  1. a) If you subscribed via our website, click on “LOGIN” (upper right corner) and then click “Subscriptions”.
  2. b) If you subscribed via the iOS app or Android app, you will need to cancel your subscription via your Apple ID Subscriptions or your Google Play Subscriptions.

All payments made through your Apple ID account are controlled and managed by Apple. Apple requires cancellation 24-hours prior to the end of your billing period. 

All payments made through your Google Play account are controlled and managed by Google Play. Google Play requires cancellation 24-hours prior to the end of your billing period.

Transformation with Chris does not offer refunds or credits for unused subscription periods, accidental purchases, medical conditions, or any other reason or event unless we are required by law to do so.

Simply canceling the credit/debit card associated with a Transformation with Chris subscription does not cancel the subscription. Transformation with Chris will continue to treat this as an open account and the billing cycle will continue, resulting in a past due account that may be turned over to a third-party collection service. 

It is imperative that you speak with a Transformation with Chris Customer Support representative or submit an online ticket through the cancellation form if you wish to initiate the cancellation of your Transformation with Chris subscription.

Cancellation of a subscription does not dismiss outstanding invoices or nullify previously agreed charges. At the time of cancellation, any outstanding balance must be settled. All canceled subscriptions with an outstanding balance may be turned over to a third-party collection service.

Promotions

We may offer special promotions, trials, discounts, offers, or coupons from time to time directly through the Website or through third parties, subject to any third party’s terms and conditions separate from our Terms and Conditions. It is your responsibility to read and understand any third-party terms and conditions.

Any trial offers or subscriptions will automatically roll over to a paid subscription unless canceled at the end of the promotional period, or unless otherwise stated.

Transform Coaching Services

1:1 Coaching Services purchased from Transform must be used within the timeframe specified at the time of purchase. Specifically, Coaching Services must be used within 60 days after purchase and within 30 days after commencement of use of the Services, unless otherwise stated at purchase. Coaching Services and all other Service fees are nonrefundable. In the event of cancellation, Transform will not prorate any portion of unused Service fees, and amounts due to Transform must be paid in full.

Third-Party Products and Advertising Usage

In the event Transformation with Chris collects fees for any third-party products and/or services, including but not limited to advertising usage, the fees are nonrefundable.

Billing Disputes / Chargebacks

Each Transformation with Chris customer agrees to provide Transformation with Chris 30 days to attempt settlement of any billing dispute before disputing with any third-party credit/debit card company or bank. Should Transformation with Chris receive a chargeback from a third-party credit/debit card company or bank on the customer’s behalf before Transformation with Chris has been given a chance to resolve the issue, Transformation with Chris has the right to charge the customer for its time spent in resolving such disputes and any associated fees incurred by Transformation with Chris. Regardless of the outcome of the chargeback, Transformation with Chris retains the right to collect on any Services or fees that are due. Transformation with Chris may submit any disputed amounts to a collection agency. Once a chargeback has been received, Transformation with Chris has the right to suspend the account until the matter is resolved.

Delinquent Payments: In the event, any payment is 15 days past due the account may be disabled until balances are paid in full. When disabled, all access will be suspended and data will be unavailable.

Deactivation: Once an account is delinquent for 60 days, it may be canceled due to non-payment. Once canceled, the customer will not be able to recover any files until the account is current. Application data may be stored for up to 60 days post-cancellation; after 60 days, application data will no longer be available. In this event, the account record and delinquent balance will be submitted to a third-party collection service.

Refunds

Subscription fees are non-refundable and will not be prorated at any time. We do not offer refunds or credits for unused subscription periods, accidental purchases, medical conditions, or any other reason or event unless we are required by law to do so. Any unused portion of your free trial period will be forfeited upon purchase of a subscription.
